Employment Law

The law requires that all people, no matter their race, age, gender, nationality, ethnicity, or disability must be treated fairly and equally in the workplace, and be free from hurtful attitudes, comments and actions. The law also requires that workers be paid the wages they are promised, and receive time and a half for overtime.

Unfair workplace treatment can include termination, harassment, unpaid wages and/or overtime, failure to receive a promotion, demotion, relocation, having hours cut or position changed, or simply being subjected to an atmosphere which is hostile to your race, age, gender, nationality, ethnicity or disability. Employers are obligated to provide tolerance and accommodation to their employees and to require the same between their employees.

The law though does not generally prohibit simple inconsideration or actions taken by employers that are motivated by genuine business concerns, and distinguishing between legal and illegal actions is difficult to do without a thorough knowledge of the law. In addition, there is an interplay of federal, state and city law that must be taken into account regarding the remedies available, what claims to make and in which court to make them.

The proof required to bring a winning case of employment discrimination must then be gathered, analyzed and presented, and the employer’s version of events must be proved wrong. This complex process requires an experienced and dedicated attorney who will work closely with you to get to the bottom of the matter and to obtain fair compensation for your unfair treatment.
